Application of Terms and Conditions: These Terms and Conditions shall apply to all (sales, rentals, and service) transactions by TNT Brands, Ltd., hereby referenced as TNT to any Customer and shall apply in place of, and prevail over, any previous terms or conditions unless specifically agreed to in writing by TNT Brands, Ltd.

Warranty: The warranty delivered by TNT or other supplier thereof shall be the sole warranty, expressed or implied of the product purchased, leased, or rented. Under no circumstances shall TNT's liability exceed the cost of the defective or damaged product. Product registration for the commencement or extension of warranty must be completed by the end-user (purchaser) of the items. Warranties may not be honored if warranty registration by the end-user is not completed.

Substitution and Pricing Disclaimer: Because of the constantly improving state of technology, we reserve the right to revise, change and/or substitute product features, dimensions, specifications, architectural detail, designs, and prices with appropriate consultation with the customer. All prices are subject to change without notice. We make every effort to provide you the most accurate, up-to-date prices and specifications. In the event a product is listed with an incorrect price due to typographical, photographic, or technical error or error in pricing information received from our suppliers, TNT Brands, Ltd. shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. If an item's correct price is lower than our stated price, we will charge the lower amount and ship you the item. If an item's correct price is higher than our stated price, we will notify you of the price error and give you the opportunity to either cancel your order or purchase the item at the correct price. While we make every attempt to verify prices before charging your credit card, TNT Brands, Ltd. reserves the right to refuse or cancel any orders placed, whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, TNT Brands, Ltd. shall immediately issue a credit to your credit card account in the amount of the incorrect price.

Transfer of Ownership: Ownership of the item(s) purchased will be transferred to the customer or recipient based on the FOB point definition as stated on the customer invoice or related product quotation. For those items shipped "FOB Destination", ownership is transferred upon delivery of the item(s) to the assigned delivery or shipping point. Items shipped "FOB Shipping Point" or "FOB Origin", ownership is transferred once the item(s) leave the shipping dock of the shipper (TNT or assigned shipping point). Shipping charges may be indicated as a separate line item on the Invoice for either FOB point. For On-Line Orders Shipping charges from TNT or their approved agent along with any appropriate insurance will be the responsibility of the customer. Shipping charges will be indicated as a separate line item on the On-Line Invoice. You will be charged $50.00 plus return shipping charges for any shipment that is refused. TNT does not ship on Saturday or Sunday.

Returned Items: Products purchased, which are available for rental by TNT, will incur a restocking fee equivalent to our posted daily rental rate multiplied by the number of days since receipt by the customer until the returned item is accepted by TNT or a restocking fee of 20% plus freight charges, which ever is greater. All other products will incur a 20% plus freight charges restocking fee. Items returned damaged or in non-new condition may incur additional charges not to exceed the replacement or repair cost of that item.

Returned Items Purchased On-Line: Products purchased On-Line may be returned within 5 days of receipt if it is in its original, undamaged factory sealed container with an approved RMA from TNT (see below) and may be subject to a 10% restocking fee. If an item is determined to have been received DOA within 15 days of receipt, a replacement unit will be issued at no cost once the DOA unit is received. An RMA (Return Materials Authorization) number must be obtained prior to returning DOA units. After 15 days from receipt of the product(s), there will be a restocking fee of 20% plus freight charges for any item returned. Items returned damaged or in non-new condition may incur additional charges not to exceed the replacement or repair cost of that item.

Returns: A Return Materials Authorization (RMA) number is required before any items are returned to TNT. Items returned to TNT without an RMA may be refused for delivery. To obtain an RMA, call TNT (or request via e-mail to customercare@tntbrands.com) between 9:00am and 4:00pm CST, describing the product, its serial number, invoice number, and brief description of the problem. All items must display the RMA on the shipping label and must be shipped pre-paid. Shipping charges are not refundable. Any manuals, cables, etc., that are missing will result in the rejection of the return or an additional restocking fee will be assessed.

Methods of Payment: TNT accepts Visa, MasterCard, Discover, and American Express. Purchase orders and company checks will be accepted with prior credit approval from our accounting department. All payments must be in US dollars. Texas residents and businesses are subject to all applicable sales tax. Items shipped outside the U.S.A. borders or to companies or individuals outside the U.S.A. will require wire transfer of funds before any items shipped.

Methods of On-Line Payment: TNT accepts Visa, MasterCard, Discover, and American Express with US Bank issued credit card with US Funds only. Purchase orders and company checks will not be accepted for On-Line orders. Items purchased On-Line will only be shipped to U.S. addresses. Texas residents and businesses are subject to all applicable sales tax. Purchase Orders: Purchase Orders received by TNT from a Customer which are approved by and endorsed by said Customer will be construed as a Contract and/or Agreement to Purchase said item(s). Customer may cancel purchase Orders received by TNT without incurring any restocking fees providing that the cancellation by an authorized person of the Customer occurs before the purchased items are shipped to fulfill the Purchase Order. If the items within the Purchase Order have already been shipped prior to notice of cancellation, above Restocking Fees may apply.

Invoices and Payments: In the event of the Customer’s default in payment for products, the Customer shall be responsible for all reasonable costs and expense incurred by TNT in collecting any sums owed by the Customer (including any costs of collecting on a judgment), and TNT shall not be obligated to make any further deliveries to the Customer. Such reasonable costs and expenses shall include, but not be limited to, reasonable attorney's fees. Payments received 30 or more days past invoice due date shall be subject to and accrue interest at a rate of 1.5% per month or the highest allowed by Texas state law to defray TNT's cost of carrying such balance. TNT and Customer agree that the exclusive jurisdiction and venue of any action brought to collect past due invoices or statements or to enforce any provision of this agreement shall be the Circuit Court of Dallas County, TX. Customer agrees that the Customer will not institute any litigation against TNT upon any claim whatsoever except in the Circuit Court of Dallas County, TX. Customer further agrees that the Customer will not set off any disputes or claims against undisputed invoices or statements.

Invoices and Payments for On-Line Orders: Invoices for On-Line orders are disclosed once the order is placed while on-line. Payment for On-Line orders will be made via VISA, MasterCard, Discover, and American Express only.
